West Valley City man charged with automobile homicide

A West Valley City man was charged Monday with automobile homicide after police say he was driving while drunk before a collision that killed a 76-year-old man.

Gary Ray Marshall, 53, was charged in 3rd District Court with a second-degree felony for a crash on March 31 at 3700 S. Redwood Road that killed Richard Learned of Sandy.

Charging documents say tests showed Marshall had a blood-alcohol content of 0.129, more than double the legal limit of 0.05. They also say that he was driving more than 68 mph in a 40 mph zone.

A witness said she saw a car driven by Marshall switch lanes and hit an SUV carrying Learner, causing it to spin twice and then roll.
