Utah shopkeeper won’t be charged after fatally punching a customer in a fight over a soda

A convenience store owner will not be charged after fatally punching a customer during an argument over a soda fountain drink last month in Clearfield.

The Davis County Attorney’s Office determined there was “no reasonable likelihood” that the storeowner would be convicted if he was charged with a crime.

Brandon Stufflebean, 39, of Layton, went into the store at 680 N. Main St. on the afternoon of April 10, where he got into an argument with the store owner about buying a drink, police said.

The store owner punched Stufflebean in the face; not long after that Stufflebean was found unconscious in the parking lot, with a “serious head injury,” police said.
