A woman stood next to her attorney in 3rd District Court on Tuesday and recounted what she could remember from a sexual encounter a year and a half ago.
Masina had accepted a plea deal in October, where charges were downgraded from first-degree felony rape and two first-degree felony charges of forcible sodomy to three class A misdemeanor sexual battery counts.
Judge Keith Kelly ordered Masina to serve jail time on only one of the counts. Jail time on the other two counts was suspended.
Kelly had ruled against allowing prosecutors to present pornographic photos found on Masina’s cellphone, as well as testimony from the victim’s ex-boyfriend regarding a Snapchat video that he said showed Masina having sex with the victim without her knowing she was being filmed.
