A panel of California appellate judges ruled Monday that the defamation lawsuit filed by former USC assistant coach Todd McNair against the NCAA can proceed and affirmed most of a lower court’s earlier ruling.
The NCAA sought to have the case, filed by McNair in 2011, thrown out, but a three-judge panel from the 2nd District Court of Appeal agreed, in large part, with a previous ruling and opined that McNair’s case “has demonstrated a probability of prevailing on the merits.”
The NCAA now has 40 days to petition the California Supreme Court for a review, or 15 days to ask the appellate court to reexamine the case and reconsider its decision.
