Win for Kaepernick: Arbitrator sends his collusion case against NFL to trial

Colin Kaepernick and his legal team scored a victory over the NFL Thursday when an arbitrator allowed the former 49ers quarterback’s collusion grievance to proceed to trial.

Arbitrator Stephen Burbank denied the NFL’s request for summary judgment, allowing Kaepernick’s case to be presented to a jury.

Kaepernick’s representatives contend the NFL has colluded against the ex-49ers star, who hasn’t been able to find work in the NFL since leaving San Francisco. Kaepernick has been a polarizing figure even since he began protesting social injustices by taking a knee during the playing of the national anthem.

The league had contended Kaepernick’s attorneys had not met the burden of proof stipulated by the collective bargaining agreement between the NFL and its players association.
