Senior U.S. District Judge Joseph Hood granted a motion to dismiss the case on Wednesday, saying KSR's speech was protected under the First Amendment.

The lawsuit was first filed in October 2017 in U.S. District Court in Nebraska and later moved to the Eastern District of Kentucky.

It alleged KSR and its operators Matt Jones and Drew Franklin harmed Higgins' family and his business, Weatherguard, by sharing Higgins' personal and business information online and on radio broadcasts.
