Deputy cleared in West Boca shooting death

A Palm Beach County Sheriff's deputy will not be charged in the April 2, 2014, shooting death of a 28-year-old mentally ill West Boca man, State Attorney Dave Aronberg concluded in a letter released Wednesday.

Prosecutors determined that Deputy Evan Rosenthal was justified in firing four fatal shots at Matthew Pollow because he was carrying a Phillips head screwdriver, coming toward the officer, and refusing to drop the tool.

"When the deputy felt his life at risk, he fired his service weapon," Aronberg wrote in his report to Sheriff Ric Bradshaw. "The shooting was a reasonable use of force given the totality of the circumstances and the information known by the deputy at the time.
